CHARITABLE RAFFLE OFFICIAL RULES
NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT IMPROVE YOUR CHANCES OF WINNING.
Catholic Charities of Southern Nevada (“Sponsor”), a tax exempted organization under Section 501(c)(3) of the Internal Revenue Code, is pleased to introduce the New Home Raffle Supporting Meals on Wheels Southern Nevada (the “Charitable Raffle”) conducted pursuant to NRS Chapter 462 to raise funds for ongoing charitable purposes. As a condition of participating in the Charitable Raffle and purchasing a ticket, you agree to be fully and unconditionally bound by these Official Rules and the decisions of Sponsor, whose decisions shall be final and binding in all respects, and you agree to waive any right to claim ambiguity in the Charitable Raffle, these Official Rules, Charitable Raffle materials, and information contained on Sponsor’s website or social media accounts. The Charitable Raffle is subject to applicable federal, state and local laws and regulations and is VOID WHERE PROHIBITED OR RESTRICTED BY LAW. Winning and receiving a Prize (as defined in Section 5) is contingent upon fulfilling all requirements set forth herein.
- SOCIAL NETWORKING WEBSITE DISCLAIMER. As a condition of participating in the Charitable Raffle, you agree and acknowledge that, Meta Platforms Inc., Instagram LLC, Google LLC, and X Corp., and their owners directors, officers, employees, contractors, agents, representatives, parents, subsidiaries, attorneys, insurers, and associated entities (collectively, the “Social Media Group”) are not sponsors of the Charitable Raffle, nor do they endorse or administer the Charitable Raffle, nor are they in any way associated with the Charitable Raffle. All questions regarding the Charitable Raffle must be directed to Sponsor, not the Social Media Group. You also agree that as a condition of participating in the Charitable Raffle, you shall release the Social Media Group from any and all liability arising out of or relating to your participation in the Charitable Raffle or acceptance, use, or misuse of the Prize.
- CHARITABLE RAFFLE ENTRY PERIOD. The Charitable Raffle begins at 12:00:01 a.m. Pacific Daylight Time (“PDT”) on June 1, 2025 and ends at 11:59:59 p.m. PDT on July 31, 2025 (the “Entry Period”). PDT shall control for all purposes of the Charitable Raffle. Sponsor’s computer shall be the official clock of the Charitable Raffle.
- ELIGIBILITY. The Charitable Raffle is open to persons who: (i) are residents of the United States and are physically located in the State of Nevada at the time of the purchase of a Charitable Raffle ticket as described in Section 4 below; (ii) are eighteen (18) years of age; and (iii) at all times abide by these Official Rules. The Charitable Raffle is void where prohibited or restricted by law. The Charitable Raffle is subject to all applicable federal, state and local laws and regulations.
Persons in any of the following categories are NOT eligible to participate or win a Prize in the Charitable Raffle: (i) all directors, officers and employees of Sponsor, all Sponsor Agencies and Loving Hearts Adoption Services; (ii) any persons or affiliates of persons who are Sponsor’s media or promotion partners and/or Prize donors, including, without limitation, Touchstone Living, Inc., Touchstone Deer Springs LLC, builders, developers, ticket outlets and sellers, auditors, accountants, or their respective affiliates; (iii) individuals contracted to or employed by a company that is engaged in the development, production or distribution of materials for the Charitable Raffle; and (iv) persons who are immediate family members (defined as mother, father, sister, brother, daughter, son or spouse) of any person in any of the preceding categories and individuals living with them in the same household (defined as those persons who share the same residence at least three months a year). “Step” relationships are also covered by this section and are not eligible to enter.
- HOW TO ENTER. During the Charitable Raffle Entry Period, eligible individuals can enter the Charitable Raffle by purchasing a ticket or ticket packs on vegasnewhomeraffle.com and following the instructions to submit a ticket reservation. An individual must fill out all applicable information and submit appropriate payment to be eligible to enter and purchase a ticket. A single ticket will cost twenty-five dollars ($25), or an individual may elect to purchase a ticket pack consisting of five (5) tickets for $100 or fifty (50) tickets for $500. There is a limit of 999 single transactions per entry for the Charitable Raffle. Tickets must be purchased no later than 11:59:59 pm PDT by the end date of the Entry Period to be eligible for entry into the Charitable Raffle.
Only one eligible person may be entered in the Charitable Raffle per each ticket transaction. If the name of more than one person is submitted with a ticket transaction, and the ticket or a ticket from the ticket pack is selected as a winning ticket, then the person named first will be deemed the holder of record of that ticket and declared the winner. Division of any Prize by a group purchasing a raffle ticket in common shall be the sole responsibility of the person named as the holder of record of that raffle ticket, should that raffle ticket be selected as a potential winner.
False or deceptive entries or acts will render an individual ineligible to participate, and Sponsor reserves the right to disqualify any individual who attempts to undermine the legitimate operation of the Charitable Raffle, acts in a disruptive manner or violates these Official Rules. Sponsor is not responsible for incorrect or inaccurate transcription of any entry information, computer, online or human error, technical malfunctions, any omission, interruption, defect, or any other error, including, but not limited to, lost, late, incomplete, invalid, unintelligible or misdirected entries, all of which may constitute grounds for disqualification in Sponsor’s sole discretion. If a problem occurs in the entry process, each individual is solely responsible for verifying that the entry process has been validly completed. Sponsor shall have no obligation to advise an individual of an incomplete or invalid entry. All entries become the sole and exclusive property of Sponsor and will not be acknowledged or returned. Each individual is responsible for all online charges incurred with any Internet service provider and/or wireless carrier. Sponsor reserves the right to reject any ticket reservation request that is submitted with payment that does not constitute “good funds.” A ticket issued in exchange for a check returned for “insufficient funds,” or for a credit card charge that was declined, invalid, stolen or unauthorized is void and cannot be a winning ticket. No refunds will be made for ineligible purchases. Refunds will only be made in Sponsor’s sole and absolute discretion.
The Internal Revenue Service (“IRS”) has ruled that a payment for a Charitable Raffle ticket is a tax-deductible charitable contribution only to the extent the amount of the payment exceeds the price of the ticket, therefore purchases of tickets in this Charitable Raffle are not tax-deductible.
- PRIZE AND ODDS OF WINNING. Subject to verification of eligibility and compliance with these Official Rules, one (1) Prize will be awarded via the Charitable Raffle. The winner will win one (1) of the following items based on the corresponding requisite conditions being satisfied:
- If $500,000 USD or more of ticket sales have been generated as gross revenue by the end of the Entry Period, the potential winner may elect one (1) of the following:
(i) Ownership of the real property commonly known as 2870 Heritage Gold Court, North Las Vegas, Nevada, 89096 (APN: 124-24-215-082) (the “House”), a 1,352 Sq Ft. (Interior), 1,412 (Including Covered Balcony) – 3 bedroom – 2.5 Bathrooms – 2 Car Garage home – features and amenities included as is provided by Touchstone living. The fair market value, or approximate retail value, of the House is approximately $363,990 USD; or
(ii) A cash award of $250,000 USD (the “Grand Cash Prize”). The ARV of the Grand Cash Prize is $250,000.
Only one (1) of the foregoing Prize may be selected.
- If between $100,000 to $499,999.99 USD of ticket sales have been generated as gross revenue by the end of the Entry Period, a potential winner will receive a cash award of $100,000 USD (the “Cash Prize”) to be deposited by Sponsor, or an affiliated partner, into the respective winner’s checking account or awarded by check to the potential winner, at winner’s discretion. The ARV of the Cash Prize is one hundred thousand dollars ($100,000 USD) (“Cash Prize”).
- If fewer than $100,000 USD of ticket sales have been generated as gross revenue by the end of the Entry Period, a potential winner will receive a cash award equal to fifty percent (50%) of the total ticket sales (the “Ticket Revenue Cash Prize”). The Ticket Revenue Cash Prize is to be deposited by Sponsor, or an affiliated partner, into the respective winner’s checking account or awarded by check to the potential winner, at winner’s discretion.
While the potential Prize winner may only elect to receive one of either the House or the Grand Cash Prize, and while the potential Prize winner may receive either the Cash Prize or the Ticket Revenue Cash Prize, depending on gross revenue generated by ticket sales, such items shall be collectively referred to as the “Prize.” The maximum approximate retail value of the Prize that can be awarded is approximately $363,990 USD. The approximate retail value of the Prize is subject to change based on current market conditions at time of Prize fulfillment. Any difference between the approximate retail value and the actual value, if any, will not be awarded.
The Prize is subject to taxation. All federal, state, and local taxes, and all costs and expenses related to the acceptance and use of a Prize not specified herein as being provided are the sole responsibility of the winner regardless of whether the Prize is used in whole or in part. Winner may be required to provide her or his Social Security Number or tax ID for tax reporting purposes if the Sponsor is required to file an IRS form with the IRS for the fair market value of a Prize awarded and accepted. The Sponsor shall have no responsibility or obligation to a Prize winner or a potential winner who is unable or unavailable to, or who does not, for any reason, accept or utilize the Prize. In the event of non-compliance with these Official Rules, or if the Prize is unclaimed, the Prize will be forfeited. Any forfeited Prize may be awarded to an alternate potential winner at Sponsor’s sole discretion.
- PRIZE SELECTION AND PROCEDURES. All eligible entries submitted during the Entry Period will be entered into one (1) drawing pool from which a Prize winner will be randomly drawn on or about August 1, 2025. The winner must not be present to win but such individual is only the potential winner of any Prize until potential winner’s compliance with these Official Rules has been verified, in accordance with these Official Rules.
Sponsor will attempt to contact the potential winner by sending a Winner Notification Agreement (“WNA”) by secure electronic communication, FedEx, or certified U.S. mail, return receipt requested, to the email and/or mailing address provided by the purchase via email and/or phone within ten (10) calendar days of the drawing. If more than $500,000 of tickets sales have been generated as gross revenue, a potential winner will have five (5) calendar days to determine if the Prize will be the House or the Grand Cash Prize by indicating potential winner’s selection on the WNA and returning to Sponsor within ten (10) calendar days of receipt of the WNA. If no selection is made by this date, Sponsor reserves the right to elect the Prize on behalf of the potential winner or select a new potential winner. If less than $500,000 of ticket sales are generated as gross revenue, the Prize will be disbursed as stated in Section 5.
Sponsor shall have no liability for a potential winner’s failure to receive notices, including the WNA, due to spam, junk e-mail or other security settings or for the potential winner’s provision of incorrect or otherwise non-functioning contact information. If a potential winner fails to respond to the verification notification within five (5) calendar days after the date the WNA was received by the potential winner, the potential winner may be disqualified in Sponsor’s sole and absolute discretion. Sponsor may also extend the verification notification at its discretion.
Before the Prize is provided, the potential winner may be required to execute a notarized affidavit of eligibility, a publicity release, a liability release (where lawful), and a W-9 which must be completed, or the Prize will be forfeited. In the event of noncompliance, or if the potential winner cannot be reached as set forth above, or if the Prize is unclaimed, the Prize will be forfeited and an alternate potential winner, at Sponsor’s sole discretion, may be selected by random drawing. All decisions of Sponsor are final.
- ODDS OF WINNING. Odds of winning the Prize depend on the number of eligible entries received during the Charitable Raffle Entry Period.
- GENERAL PRIZE RESTRICTIONS. Winning the Prize is contingent upon accepting these Official Rules and fulfilling all requirements of these Official Rules. No more than the stated Prize will be awarded. The Prize is subject to the terms and conditions of the Sponsor. The Prize may not be transferred or assigned. Any Prize won for this Charitable Raffle may not be used to fundraise for another 501(c)(3) charity. Unless otherwise stated in these Official Rules, no Prize substitutions will be made, except that Sponsor, at its sole discretion, may substitute a Prize of equal or greater value for any reason.
The Grand Cash Prize, the Cash Prize, or the Ticket Revenue Cash Prize, as the case may be, will be deposited by Sponsor, or an affiliated partner, into the winner’s checking account or awarded by check to the winner, at winner’s discretion. The Prize funds will be available within thirty (30) calendar days from the date of receipt of the necessary confirmation as well as the return of any requested forms and information from the potential winner. Sponsor assumes no liability for non-deliverability, or any transactional delays, including shipping delays.
Any depiction of the Prize, in Charitable Raffle materials or otherwise, is for illustrative purposes only. If the actual retail value of the Prize is less than the stated approximate retail value, the Prize winner will not receive the difference. Likewise, there are federal taxes and may be state and/or local tax consequences depending on whether the winner selects the House or the Grand Cash Prize or receives the Cash Prize or the Ticket Revenue Cash Prize. Sponsor takes no responsibility for the winner’s tax liabilities. All expenses not specified above, including any federal, state or local taxes are the sole responsibility of each Prize winner. Any required tax reporting forms will be furnished to the appropriate authorities. Sponsor reserves the right to withhold and deduct taxes and charges from the Prize if and to the extent required by law. With respect to any Prize with a value of more than $5,000, the IRS requires Sponsor to withhold federal income tax at the rate of 24%, or the current rate as established by the IRS, and the potential winner must pay the amount of tax to be withheld to Sponsor as a condition of transfer of ownership of the Prize. If applicable, Sponsor may be required to withhold state tax at the current rate as established by the state, commonwealth or country in which the potential winner resides. In the event that the Charitable Raffle is cancelled or postponed for any reason whatsoever, the approximate retail value of the Prize will be awarded to the extent required by law.
House Prize Conditions
In addition to the above, the potential winner who chooses the House as the Prize agrees that the value of the property reported by Sponsor for income tax and other purposes will be based on the written appraisal obtained by Sponsor from a licensed appraiser. Sponsor does not guarantee that a potential winner who receives the House will be able to sell it for the appraisal value or that the IRS will use that value in its tax evaluations. If the potential winner chooses the House as the Prize, the potential winner assumes all fees, local, state and federal taxes (including, but not limited to, income taxes based on the value of the House), financing costs (including, but not limited to, closing costs, title insurance, and transfer tax and fees), which may have to be paid when the House is transferred to the winner and the Prize is subject to any covenants, rules, fees, or other restrictions administered by a homeowners’ or townhome association, or other common interest community, including but not limited to, property taxes and homeowner association fees. Further, the potential winner agrees to assist and/or provide all necessary information to Sponsor, or an affiliated partner, in order to successfully coordinate the transfer of the title of the House. Failure to do so shall result in the forfeiture of the House as the Prize.
ALL PRIZES ARE AWARDED AS IS AND WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. SOME JURISDICTIONS MAY NOT ALLOW (OR MAY LIMIT) DISCLAIMERS OF CERTAIN WARRANTIES, IN WHICH CASE THE FOREGOING DISCLAIMERS WILL BE ENFORCED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
- GENERAL CONDITIONS OF PARTICIPATION. By participating in the Charitable Raffle, you agree to abide by and be bound by these Official Rules. The Prize will only be awarded if the potential winner fully complies with these Official Rules. All entries become the property of the Sponsor and will not be acknowledged or returned. Entries that are lost, late, misdirected, garbled, or incompletely received, for any reason, including by reason of hardware, software, browser, or network failure, malfunction, congestion, or incompatibility will not be eligible.
As a condition of participating in the Charitable Raffle, you also agree to release, indemnify and forever hold harmless Sponsor, Catholic Charities of Southern Nevada Adoption Services, Prize suppliers, including Touchstone Living Inc. and Touchstone Deer Springs LLC, and Sponsor’s business partners involved in the operation and promotion of the Charitable Raffle, and each of their respective agents, affiliates, representatives, officers, managers, directors, members, shareholders and employees (the “Released Parties”) from and against any injuries, losses, damages, claims, actions and any liability of any kind resulting from or arising from any breach of representation made by you in connection with the Charitable Raffle, the exercise by Sponsor or its designees of any of the rights granted by you in these Official Rules and your participation in the Charitable Raffle, including acceptance, possession, use, misuse or nonuse of the Prize.
Sponsor reserves the right to modify, suspend or terminate the Charitable Raffle for any reason, including, without limitation, suspected or actual evidence of tampering with any portion of the Charitable Raffle, unauthorized intervention, fraud, or technical difficulties or failures that compromise or corrupt or affect the administration, integrity, security, fairness, or proper conduct of the Charitable Raffle. In the event that the Charitable Raffle is cancelled or terminated for any reason whatsoever, the approximate retail value of the Prize will be awarded to the extent required by law. Sponsor also reserves the right to remove from or to deny entry into the Charitable Raffle any entrant who engages in a non-sportsmanlike or disruptive conduct, or acts with the intent to annoy, abuse, threaten or harass any other person participating or involved with the Charitable Raffle.
If, for any reason, the Charitable Raffle operation is subjected to infection by computer virus or bugs, tampering, unauthorized intervention, fraud or suspected fraud, technical failures, or any other causes which call into question the fairness or legality of this Charitable Raffle, Sponsor may, in its sole discretion, void any suspect entries and (i) cancel or terminate the Charitable Raffle (or any portion thereof); (ii) modify the Charitable Raffle or suspend the Charitable Raffle and then resume the Charitable Raffle in a manner that best conforms to the spirit of these Official Rules; and/or (iii) award the Prize from among the eligible, non-suspect entries received up to the time of impairment.
ANY ATTEMPT BY AN ENTRANT TO UNDERMINE THE LEGITIMATE OPERATION OF THE CHARITABLE RAFFLE MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK CIVIL AND/OR CRIMINAL PROSECUTION AND DAMAGES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT OF THE LAW.
These Official Rules cannot be modified or amended in any way except in a written document issued in accordance with law by a duly authorized representative of Sponsor. The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.
- LIMITATIONS OF LIABILITY. To the maximum extent permitted by law, Sponsor and the Released Parties are not responsible for: (i) stolen, lost, late, misdirected, damaged, undeliverable, incomplete, inaccurate, delayed or illegible entries due to technical, computer, mechanical, printing, typographical, human or other errors relating to or in connection with the Charitable Raffle, including, without limitation, errors which may occur in connection with the administration of the Charitable Raffle, the submission of entries, notification or correspondence, the processing of entries, the announcement of the Prize or in any Charitable Raffle related materials; (ii) technical failures of any kinds; (iii) failures of any of the equipment or programming associated with or utilized in the Charitable Raffle; (iv) unauthorized human and/or mechanical intervention in any part of the entry process or the Charitable Raffle; (v) technical or human error that may occur in the administration of the Charitable Raffle; or (vi) any injury or damage to persons or property that may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Charitable Raffle or receipt or use of any Prize. If for any reason an entrant's entry is confirmed to have been erroneously deleted, lost or otherwise destroyed, corrupted or for any other reason not accepted as an entry into the Charitable Raffle, entrant's sole remedy is to enter again into the Charitable Raffle. Sponsor may rescind any Charitable Raffle entry found to contain such errors or failures without liability at its sole discretion.
Each winner hereby releases and forever holds Sponsor and the Released Parties harmless with respect to any claims related to the Charitable Raffle. An entrant’s sole and exclusive remedy for any breach of duty or conduct related to the Raffle shall be limited to the return of the purchase price paid for a ticket.
As a condition of participating in the Charitable Raffle, you agree that as to Sponsor and the Released Parties: (i) under no circumstances will you be permitted to obtain awards for, and you hereby waive all rights to claim, loss or injuries to earnings, profits or goodwill, punitive, incidental, consequential, or any other damages, other than for actual out-of-pocket expenses; (ii) all causes of action arising out of or connected with the Charitable Raffle, or any Prize awarded, shall be resolved individually, without resort to any form of class action; and (iii) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, but shall in no event include attorneys’ fees. Sponsor reserves the right to modify Prize award procedures.
- PUBLICITY RELEASE AND USE OF PERSONAL INFORMATION. Except where prohibited by law, by entering in this Charitable Raffle and/or accepting the Prize, you grant Sponsor and its designees the right to use your name, photograph, likeness, statements, biographical information, testimonials, personal story, voice, address, and other identifying information for any and all commercial purposes of the Sponsor, including, without limitation, advertising and Charitable Raffle purposes for this and similar Charitable Raffles, worldwide, and in perpetuity, in any and all forms of media, now known or hereafter devised without additional compensation, review or approval rights, notification or permission.
By entering the Charitable Raffle, entrants acknowledge they will be sharing their personal information with Sponsor. In addition, by entering, entrants agree to Sponsor's use of entrant's personal information as described in its respective Privacy Policy. Please refer to Sponsor's Privacy Policy, available at https://www.catholiccharities.com/privacy-policy for important information regarding our collection, use and disclosure of personal information. Sponsor is not responsible for disclosures made by any third party.
YOU FURTHER ACKNOWLEDGE THAT YOUR PERSONAL IDENTIFYING INFORMATION MAY BE DISCLOSED TO THIRD PARTIES INCLUDING, WITHOUT LIMITATION, PLACING YOUR NAME ON A WINNER’S LIST.
- DISPUTES. By participating, you agree that any and all disputes, claims, and causes of action arising out of or in connection with this Charitable Raffle, or any Prize awarded, shall be resolved individually, without resort to any form of class action. You agree that should you have any such disputes, claims, or causes of action, you shall first allow Sponsor an opportunity to address your concerns. You further agree that if the dispute or claim is not otherwise resolved through direct discussions with Sponsor, it shall then be resolved by final and binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association ("AAA"). All proceedings brought pursuant to this paragraph will be conducted in Clark County, Nevada.
You further agree that: (i) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Charitable Raffle, and in no event will you be entitled to receive attorneys’ fees or other legal costs and (ii) under no circumstances will you be permitted to obtain awards for, and you hereby waive all rights to claim, punitive, incidental, and consequential damages, and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of you and Sponsor in connection with this Charitable Raffle, shall be governed by, and construed in accordance with the laws of the State of Nevada, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of Nevada or any other jurisdiction), that would cause the application of the laws of any jurisdiction other than the State of Nevada and the forum and venue for any dispute shall be in Clark County, Nevada.
- EXTENDED MEANINGS; CURRENCY; FORCE MAJEURE. Unless otherwise specified in these Official Rules, words importing the singular include the plural and vice versa and words importing gender include all genders. All dollar amounts referred to in these Official Rules are in lawful money of the United States of America. The Released Parties are not responsible for any damages caused by delay or failure to perform undertakings pursuant to these Official Rules when the delay or failure is due to weather, event cancellations, fires, strikes, floods, pandemics, acts of God or the state’s enemies, lawful acts of public authorities, delays or defaults caused by common carriers, or other events that cannot reasonably be foreseen or provided against.
- SEVERABILITY/WAIVER. The invalidity or unenforceability of any provision of these Official Rules will not affect the validity or enforceability of any other provision. In the event that any provision of the Official Rules is determined to be invalid or otherwise unenforceable or illegal, the other provisions will remain in effect and will be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. The Sponsor’s failure to enforce any term of these Official Rules will not constitute a waiver of that provision.
- LIST OF OFFICIAL RULES OR WINNERS’ LIST. A complete copy of these Official Rules can be obtained by sending a self-addressed, stamped envelope to Catholic Charities of Southern Nevada, 1501 Las Vegas Blvd., North Las Vegas, 89101.
